NIKE GIFT CARD TERMS AND CONDITIONS

Please read these terms and conditions carefully before purchasing a gift card. NIKE China Holding HK Limited is referred to in these Terms and Conditions as “Nike/we/us.”

This agreement has immediate effect.
This agreement is a contract between you as the card user and NIKE China Holding HK Limited as the issuer of the card.
This agreement explains your rights and obligations when applying for and using the card.
By using the card, you agree to the terms of this agreement.
The card can only be used on the Nike Hong Kong website  as “Nike.com.hk”. Nike reserves the right to not to accept any cards if we reasonably believe that the use is unauthorized, fraudulent or otherwise unlawful.

GIFT CARD PURCHASE

The card can only be purchased on Nike.com.hk.
A maximum of five (5) cards can be purchased on one order.
The card cannot be purchased together with any other products on Nike.com.hk.
Unless otherwise specified, promotional offers or discounts do not apply to the purchase of the card.
The gift card may not be used to purchase another gift card.
We currently accept the following payment methods: VISA, JCB, UnionPay, AlipayHK, Alipay, WeChat Pay HK & WeChat Pay.
The card can only be shipped to commercial and industrial residential addresses within Hong Kong, self-pickup services are not available.
The card will be activated when you receive an email from Nike confirming the date of activation.

CARD USE AND REDEMPTION

The card can only be used in full or partial payment for products purchased on Nike.com.hk. Any remaining balance can be used in future purchases.
To use the card on Nike.com.hk, you must log in to your Nike Member profile.
The card cannot be bound by any Nike Member profile.
The card cannot be used at any Nike operated physical stores or authorized retailers.
The card currently cannot be used on Nike.com geo expansions sites other than Nike.com.hk.
A maximum of one (1) card may be used on one order.
After entering your card number during checkout, the balance will be immediately deducted from the order total.
If your order total exceeds the balance on your card, you can pay the remaining amount with any accepted alternate form of payment.
The store value of the card is of (a) HK$ 300; (b) HK$ 500; (c) HK$ 888 or (d) HK$ 1,000. You cannot reload your card.
You can check the card balance and expiry date on Nike.com.hk, or contact us.
The card will expire twelve (12) months after it has been issued i.e the dispatched date. Unused amount shall be forfeited automatically upon the expiry date.

RETURN AND REPALCEMENT

The card shall not be refunded, or exchanged for cash at any time, unless you have exercised your statutory right to cancel an order on Nike.com.hk.
Nike shall not replace any card that is lost, stolen or damaged except in accordance with your legal rights. For example, if the card is defective, or has quality issue at the time of delivery. In such circumstances, please contact us. We will deactivate your card and deliver a new one to your designated address.
Any exchange of products purchased with the Card shall be subject to NIKE Returns Policy, and the amount will be returned to your original payment method. i.e. the original gift card (within expired date). Please keep the card until the order and the exchange or refund processes are completed. Otherwise, NIKE shall not able to provide another type of refund if consumer loses the card.
You must always maintain secure possession of the card and keep the card code and PIN secret.
Nike is not responsible for any transactions effected, or charges incurred, with the loss or damage of the card.
Nike is not responsible for any unauthorized transactions associated with the card.

BILLING ERRORS

Nike reserves the right to correct the balance of the card if we believe that a clerical, billing or accounting error has occurred. If you have questions regarding the transaction history or any such correction, please contact us. Nike shall have no liability for any billing error. You should monitor the transactions and account balances closely.

AMENDMENT AND TERMINATION

Your use of the card constitutes your acknowledgement of the agreement to abide by the terms and conditions set forth in this agreement.
Nike reserves the right to amend this agreement at its absolute discretion.
As permitted by applicable law, any changes, additions or deletions will be effective at the time of Nike posts the revised agreement to its website. Unless Nike states otherwise, the change, addition or deletion will apply to your future and existing cards.
Nike may suspend or terminate this agreement or revoke or limit any or all the rights and privileges granted to you at any time without notice or liability. Termination may result from your fraudulent or unauthorized use of the card.

INDEMINITY

You agree to indemnify Nike against all actions, proceedings, liabilities, claims, loss, damages and reasonable costs and expenses which may be taken against Nike or which Nike may suffer, sustain or incur (as the case be) in respect of the card unless the same were caused by any manifest error on Nike’s part.

DISCLAIMERS

Nike does not represent or warrant that your card will always be accessible or accepted.
Nike and its affiliates shall have no liability for any incidental, indirect or consequential damages (including without limitation loss of profit, revenue or use) arising out of or in any way connected with this agreement, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability or strict liability, even if Nike or its authorized representatives have been advised of the possibility of such damages.
Nike or its affiliates shall have no liability for unauthorized access to, or alteration, theft, or destruction of the card through accident, misuse, or fraudulent means or devices by you or any third party, or because of any delay or mistake resulting from any circumstances beyond our control.

ASSIGNMENT

Nike may assign all or part of its rights or obligations under this agreement without notice, if we comply with all applicable laws and regulations in respect of such assignment. Nike shall be released from all liability.

GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region of the People’s Republic of China.

ENTIRE AGREEMENT

This agreement is the complete and exclusive statement of agreement between you and Nike and supersedes all prior agreements. In the event of any provision of this agreement is rendered illegal or unenforceable, that provision will be severed, so that this agreement shall remain in full force and effect.
Should there be any dispute, Nike reserves the right of final decision.
The Chinese version of these Terms and Conditions prevails to the extent of any inconsistency between the English and the Chinese versions. Any English version of this Terms and Conditions is for reference only.
